Who we are

This policy explains how Click Seed Pty Ltd (ABN 87 656 256 567), which operates CreateAWill ("we", "us"), handles personal information collected through createawill.com.au. We handle personal information in line with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

What we collect

  • Account details: your name and email address, and your profile details if you sign in with Google.
  • Your Will: the answers you give in our questionnaire, which can include details about your family, beneficiaries, executors, guardians and assets.
  • Enquiries and bookings: the details you give us when you use our Check & Store service or ask for a referral, such as your phone number, suburb and state.
  • Documents showing your details: if you use Check & Store, copies of documents you choose to send to show how your details should be written (such as a driver licence, passport, Medicare card, certificate or bill). We use these only to check that the details in your Will are written correctly, not to verify your identity. We delete the copies once the check is complete, and do not record or keep any ID or account numbers.
  • Your signed Will: if you use Check & Store, a scanned or photographed copy of your signed Will, which we store for you.
  • Payments: payments are processed by Stripe. We don't see or store your full card details.
  • Technical information: basic information such as your browser type and pages visited, used to keep the site working and secure.

Your Will can contain information about other people, such as your family members. Please only include what is needed to prepare your Will.

How we use it

  • To create, save and let you download your Will.
  • To check your Will's details and signing, and to store a digital copy of your Will if you ask us to.
  • To respond to your questions and send you service emails (for example, booking confirmations).
  • To make referrals you have asked for (see below).
  • To keep our service secure and improve it.

We will only send you marketing emails if you have agreed to receive them, and you can opt out at any time.

Referrals to lawyers and financial planners

We are not a law firm and don't give legal or financial advice. If you ask us to, we can refer you to an estate lawyer or financial planner. We only share your name and contact details with a partner if you have ticked the consent box on our enquiry form, or otherwise told us you agree.

If you book a Lawyer Review, we share your Will and contact details with the independent solicitor carrying out the review, with your consent. We receive a referral fee from the solicitor for each review. Otherwise, we never share the contents of your Will with a partner unless you specifically ask us to.

If you're an executor and ask us to find a solicitor, we share the details you give us about the estate, and your contact details, with a solicitor on our panel, with your consent. Panel solicitors pay us a fee. If you ask for a copy of a Will stored with us, we ask for the death certificate and proof of your identity before releasing it.

We don't sell your personal information. A partner who receives your details handles them under their own privacy policy.

Who else handles your information

We use trusted service providers to run CreateAWill, including:

  • Supabase (database and account sign-in)
  • Cloudflare (website hosting and security)
  • Stripe (payments)
  • Resend (sending emails)
  • Google (if you choose to sign in with Google)

Some of these providers may store or process information outside Australia. We choose providers that protect information to a standard similar to the Australian Privacy Principles.

We may also disclose information where the law requires it.

How we protect it

Your information is encrypted in transit and stored with providers that encrypt data at rest. Access is limited to people who need it to provide our service. Digital copies of Wills we store for you are kept securely and only released to you, or after your death to your executor on proof of identity.

Accessing, correcting or deleting your information

You can view and update your Will in your account at any time. To ask for a copy of the personal information we hold, to correct it, or to close your account and delete your data, email us at support@createawill.com.au.

Complaints

If you have a concern about how we have handled your information, please email us first at support@createawill.com.au and we will respond within 30 days. If you are not satisfied with our response, you can contact the Office of the Australian Information Commissioner at oaic.gov.au.

Changes to this policy

We may update this policy from time to time. The date at the top shows when it last changed.
